Polygamy is not an integral part of Islam: SC

The Supreme Court of India ruled that a Muslim’s fundamental right to profess Islam does not include practicing polygamy, though Muslim’s personal law permits men to have four wives.

Supreme Court also added that polygamy is not an integral part of Islam.

However, the All India Muslim Personal Law Board (AIMPLB) said that it would debate the Supreme Court order which observes that polygamy is not a fundamental right of a Muslim.

What did Supreme Court of India Say?

  1. What is protected under Article 25 (right to practice and propagate any religion) is the religious faith and not a practice which may run counter to public order, health or morality.
  2. Polygamy is not integral part of religion and monogamy is a reform within the power of the State under Article 25.
